Kansas Court Rules Mushrooms are ‘Containers’ for Psilocybin if the Defendant Knows the Mushrooms Contain Psilocybin

Kansas Court of Appeals rules that mushroom are containers for psilocybin if the defendant knows they contain psilocybin.

In State v. Justice, the Kansas Appeals Court ruled that mushrooms are containers for psilocybin if the defendant knows the mushrooms contain the chemical. The court added that Florida v. Fiske only applies if the defendant is not aware that the mushrooms contain psilocybin or aware there is any illegal conduct going on.
